Last updated: 29 September 2026. These terms form the agreement between you and Eudoraz when you book an apartment with us. Please read them before you reserve. By reserving an apartment you confirm that you have read and accept these terms, our Cancellation and Refund Policy and the house rules shown on the apartment’s page.
1. About us and these terms
1.1 Eudoraz (“Eudoraz”, “we”, “us” or “our”) operates the website eudoraz.com and manages the furnished apartments listed on it. We are based in Nairobi, Kenya. You can contact us by email at stay@eudoraz.com or by phone or WhatsApp on +254 726 127 228.
1.2 In these terms:
- “Apartment” means the furnished apartment you book, including its furniture, fittings, appliances and contents.
- “Booking” means a reservation that we have confirmed in writing under clause 3.
- “Estate” means the development, building or estate in which the Apartment is located, including its shared amenities.
- “Guest” means any person who stays in or visits the Apartment under your Booking.
- “Lead guest”, “you” and “your” mean the person who makes the Booking.
- “Stay” means the period from check-in to check-out on the dates of your Booking.
1.3 These terms apply to every Booking made through eudoraz.com and, unless we agree otherwise in writing, to bookings made with us by phone, WhatsApp or email.
1.4 Nothing in these terms limits any rights you have under the Consumer Protection Act, 2012 or any other law that cannot be excluded by agreement.
2. The accommodation we provide
2.1 We grant you and your Guests a licence to occupy the Apartment for short-stay accommodation for the dates of your Booking. This is not a tenancy or lease and does not create any rights under landlord and tenant law.
2.2 The photos, descriptions, amenity lists and distances on our website are given in good faith to show what the Apartment and the area are like. Furnishings, décor and small details may vary from the photos. Distances and travel times are approximate and depend on traffic.
2.3 The exact address, directions and check-in details are sent to you after your Booking is confirmed.
3. How a booking is made
3.1 Reserving. When you choose your dates on our website and press “Reserve and pay”, you make a request to book the Apartment at the price shown. We then reserve the Apartment for you for a limited time while you pay. The time allowed is shown on the booking page and in the email we send you (currently one hour).
3.2 Paying. To keep the reservation, you must pay the full amount shown within that time, as set out in clause 5.
3.3 Unpaid reservations. If we do not receive a report of your payment within the time allowed, the reservation is released automatically, the dates become available to others and no agreement exists between us. Nothing is owed in that case.
3.4 Confirmation. A binding agreement between you and us is formed only when we have verified your payment and sent you a written confirmation by email. Until then, we may decline a reservation, for example if the dates are no longer available or the price shown was an obvious error. If we decline after you have paid, we will refund your payment in full.
3.5 Accurate details. You must give us your correct name, email address and phone number. Our emails and messages are sent to the details you give us, and we are not responsible if you do not receive them because the details were wrong.
4. Prices
4.1 All prices are in Kenya Shillings (KES). The price for your dates, including any cleaning fee or caution deposit, is shown before you reserve. We do not add booking fees.
4.2 The total shown before you reserve is the full price of your Stay. Nothing is added to it later, except any amount you agree to in writing, such as a late check-out, or any charge under clause 6.3.
4.3 Prices may change at any time before a Booking is confirmed. Once your Booking is confirmed, the price will not change unless you ask us to change the Booking.
4.4 Discounts for longer stays, where offered, apply only to the nights of a single continuous Booking and are shown in the price before you reserve.
5. Payment
5.1 Payment is by M-Pesa using Send Money to the number shown on our booking page and in our emails, or by bank transfer where we offer it. The full amount must be paid to confirm a Booking.
5.2 Protect yourself from fraud. Only pay to the M-Pesa number or bank account shown on eudoraz.com or in an email from us. We will never ask for your M-Pesa PIN or card details, and we will never ask you to pay to a different number by phone or WhatsApp. If anyone does, do not pay and contact us.
5.3 After paying, you must give us the M-Pesa transaction code, either on your booking page or by WhatsApp or email. We confirm a payment only when it appears in our own M-Pesa or bank records for the correct amount. A screenshot or forwarded message is not proof of payment on its own.
5.4 Any charges made by M-Pesa or your bank for sending the payment are paid by you.
5.5 If you pay less than the amount due, the Booking will not be confirmed until the balance is paid within the time allowed. If you pay more than the amount due, we will refund the difference.
6. Caution deposit
6.1 Some Apartments require a refundable caution deposit, which is included in the total shown before you reserve.
6.2 We return the deposit after check-out, within 7 days, to the M-Pesa number or bank account the payment came from, after we have inspected the Apartment.
6.3 We may deduct from the deposit the reasonable cost of:
- repairing or replacing anything damaged, broken or missing beyond normal wear and tear;
- extra cleaning needed because of how the Apartment was left, or because of smoking or pets where these are not allowed;
- replacing lost keys, key cards or access fobs, or resetting a smart lock;
- any fine or charge the Estate imposes because of a Guest’s conduct.
6.4 If we make a deduction, we will tell you what it is for and how much it is. If the cost is more than the deposit, or no deposit was taken, you agree to pay the balance within 7 days of our written request.
7. Guests and occupancy
7.1 The person who makes the Booking must be aged 18 or over. If you book for someone else, for example a colleague or a family member, you must give us the name of the guest who will check in, who must also be aged 18 or over, and you remain responsible under these terms together with that guest.
7.2 The number of Guests staying overnight must not exceed the maximum shown on the Apartment’s page and in your Booking. Every Guest counts towards this limit except infants under 2 years.
7.3 Day visitors are allowed between 8:00 am and 10:00 pm and must follow these terms, the house rules and the Estate’s rules. Visitors may not stay overnight unless they are included in the number of Guests on your Booking.
7.4 You are responsible for the conduct of every Guest and for any loss or damage they cause.
7.5 You may not sublet, re-sell or transfer your Booking to anyone else without our written consent.
8. Check-in and check-out
8.1 Check-in and check-out times are shown on the Apartment’s page and in your confirmation. Unless we agree otherwise in writing, you may not enter the Apartment before check-in time and must leave by check-out time.
8.2 Early check-in and late check-out are subject to availability and our written agreement, and may be charged. If you leave after the check-out time without our agreement, we may charge the price of an extra night.
8.3 Where the Apartment has a smart lock or lockbox, we will send you the access code before you arrive. You must not share the code with anyone who is not staying under your Booking.
8.4 The Estate may require Guests to show identification or register at the gate. You agree to comply with the Estate’s security procedures. We are not responsible for delays caused by them.
8.5 At check-out you must leave the Apartment in a reasonably tidy condition, close windows, switch off appliances and follow any check-out instructions we give you.
9. House rules and conduct
9.1 You and your Guests must:
- follow the house rules shown on the Apartment’s page and in the Apartment, including the rules on smoking, pets and parties;
- follow the rules of the Estate, including the rules for its shared amenities;
- respect neighbours and keep noise at a reasonable level, especially between 10:00 pm and 7:00 am;
- use the Apartment only as private accommodation and not for any commercial event, photo or video production, or other business activity without our written consent;
- not do anything illegal in the Apartment or the Estate, or anything that puts people or property at risk;
- tell us promptly about any damage, breakage or fault.
9.2 If you or a Guest seriously or repeatedly break these terms or the house rules, or behave in a way that puts people or property at risk, we may end the Stay and require everyone to leave the Apartment. In that case no refund is due for the remaining nights, and clause 6 applies to any loss or damage.
9.3 We, our staff or contractors may enter the Apartment during your Stay, after giving you reasonable notice, to carry out repairs or inspections, and without notice in an emergency or where we reasonably believe these terms are being seriously broken.
10. Amenities, utilities and the Estate
10.1 Shared amenities such as swimming pools, gyms, playgrounds and sports courts are owned and run by the Estate or its management, not by us. Their opening hours, rules and availability are set by the Estate and may change or be closed for maintenance without notice. We do not guarantee access to them and no refund is due if they are unavailable.
10.2 Electricity, water and internet are supplied by third parties. We take reasonable steps to keep them working, but we are not responsible for interruptions outside our control, such as a power or water outage affecting the area. If an interruption within our control makes the Apartment unusable, we will try to fix it promptly and, if we cannot, we will offer a fair solution, which may include a partial refund for the nights affected.
11. Changes by you
11.1 To change your dates or the number of Guests, contact us by phone, WhatsApp or email with your booking code. Changes depend on availability and must be agreed by us in writing.
11.2 If a change increases the price, you must pay the difference before the change is confirmed. If a change reduces the price and is made within the free cancellation period, we will refund the difference.
11.3 After the free cancellation period, we may agree to one change of dates per Booking, at our discretion and subject to availability. If the new dates cost less, no refund of the difference is due. If we cannot agree a change, our Cancellation and Refund Policy applies.
12. Cancellation by you
12.1 You may cancel a Booking as set out in our Cancellation and Refund Policy, which forms part of these terms.
12.2 If you do not arrive (a “no-show”) or leave before the end of your Stay, no refund is due for the unused nights, except as set out in our Cancellation and Refund Policy.
13. Cancellation or changes by us
13.1 If we have to cancel your Booking, or the Apartment becomes unavailable for reasons we did not cause, for example serious damage or a failure of services, we will tell you as soon as possible and offer you either:
- a comparable apartment, if one is available, at no extra cost; or
- a full refund of everything you have paid for the Booking.
13.2 Once we have provided an alternative apartment or a full refund under clause 13.1, we have no further liability to you for the cancellation, except where it was caused by our negligence or breach of these terms.
14. Our liability to you
14.1 We will provide the Apartment with reasonable care and skill.
14.2 We are not responsible for:
- loss of or damage to your or your Guests’ belongings, money or vehicles, unless caused by our negligence;
- any loss that was not reasonably foreseeable when the Booking was made;
- any business loss, such as loss of profit, income or opportunity;
- anything done or not done by the Estate, its management or security staff, or by utility and internet providers.
14.3 Except as set out in clause 14.4, our total liability to you for all claims arising from a Booking is limited to the total price you paid for that Booking.
14.4 Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.
15. Your liability to us
15.1 You are responsible for any loss, damage or cost we suffer because you or a Guest broke these terms or the house rules, including damage to the Apartment or its contents, extra cleaning and any fines or charges imposed by the Estate.
16. Events outside our control
16.1 We are not responsible for any failure or delay in meeting our obligations caused by events outside our reasonable control, including natural disasters, extreme weather, fire, flood, epidemics, government action, civil unrest, strikes, or failures of utilities, telecommunications or M-Pesa. If such an event prevents your Stay, we will offer you new dates or a refund of what you paid for the nights affected.
17. Complaints
17.1 If something is not right during your Stay, tell us straight away by phone or WhatsApp so we can try to fix it while you are there.
17.2 If you still have a complaint after your Stay, write to us at stay@eudoraz.com within 14 days of check-out with your booking code. We will reply within 7 days and try to resolve it fairly.
18. Your personal data
18.1 We use your personal data as described in our Privacy Policy.
19. General
19.1 Electronic communication. You agree that we may communicate with you by email, SMS and WhatsApp, and that confirmations and notices we send this way are in writing.
19.2 Changes to these terms. We may update these terms from time to time. The version in force when your Booking was confirmed applies to that Booking.
19.3 Severability. If any part of these terms is found to be invalid or unenforceable, the rest of the terms remain in force.
19.4 No waiver. If we do not enforce any part of these terms straight away, we may still enforce it later.
19.5 Entire agreement. These terms, our Cancellation and Refund Policy, the house rules for your Apartment and your confirmation make up the whole agreement between you and us about your Booking.
19.6 Third parties. Only you and we have rights under these terms.
20. Governing law and disputes
20.1 These terms and any dispute arising from them are governed by the laws of Kenya.
20.2 If a dispute arises, you and we will first try to resolve it in good faith by discussion for at least 14 days after one of us raises it in writing.
20.3 If the dispute is not resolved, the courts of Kenya have exclusive jurisdiction. Claims within its financial limit may be brought in the Small Claims Court.
20.4 This clause does not affect your right as a consumer to bring a complaint under the Consumer Protection Act, 2012.
